Enquiry Procedure 10.2.1. A Show cause notice along with a summary of the complaint will be issued to the Respondent to enable him/her to give his/her reply along with his/her list of documents and names and addresses of witnesses within 5 days (Five working days) of receiving the copy of the complaint from the Enquiry Committee. The response timeline may be reduced based on the severity of the complaint, subject to the Chairperson's decision in consultation with the Enquiry Committee. 10.2.2. Upon receipt of the response from the Respondent, the Enquiry Committee shall conduct a hearing where both the Complainant and the Respondent shall be heard in person/virtual. 10.2.3. In the event that the Respondent is not present in person /virtual at a hearing of the Enquiry Committee, the hearing shall be adjourned to a date not later than 3 (three) working days from the date of the original hearing. The hearing shall be conducted on such an adjourned date irrespective of whether the Respondent is present or not, provided that proper reasons have been submitted by the Respondent for not being present on that day. Nothing contained herein shall preclude the Enquiry Committee from adjourning such hearing for a longer period subject to recording its reasons for such adjournment and submitting the same to the Chairperson of the ICC. 10.2.4. All Employees shall extend their full co-operation with the Enquiry Committee and any failure to co-operate, or the giving of wrong or misleading information, or withholding information, shall be a violation of the Code of Conduct of the Company and they shall be dealt with appropriate actions by the Chairperson of the ICC and CHRO. 10.2.5. The Presiding Officer of the Enquiry Committee shall, within 5 (five) working days of completion of the final hearing shall forward copies of the same to the Complainant and the Respondent for their comments and further explanations, if any. Such comments or further explanations shall be submitted to the Presiding Officer of the Enquiry Committee not later than 3 (three) working days from the date of their receipt of the Report. 10.2.6. The Enquiry Committee may, after the expiry of the 3 (three) working day period mentioned above, meet to review and evaluate the Report along with further explanations/ comments of the Respondent and/ or the Complainant, if furnished by them, to ascertain as to whether a misconduct of Sexual and/or Gender harassment as complained of, or any other violation of the Act/ this Policy, has occurred. 10.2.7. In the event that the Enquiry Committee concludes from the Report and further explanations (if any), that no offence of Sexual and/or Gender harassment, nor any violation of this Policy, had occurred (reasons to be recorded in writing thereon), the Presiding Officer of the Enquiry Committee shall forward the Report along with the Findings to the Chairperson of the ICC, within 10 (ten) working days from the date of receipt of feedback from Complainant / Respondent.
